The Department for Foreigners of the Małopolska Provincial Office in Kraków would like to inform about partial resumption of in-person customer service.
Registration UE, residence card for family member of the UE citizen, permanent residence card for UE citizen collection (from May 25th, 2020)
Starting from May 25th, 2020 the possibility of Registration UE, residence card for family member of the UE citizen, permanent residence card for UE citizen collection is partially resumed. We’re only going to issue cards to individuals which we have previously contacted via phone or sent an email. Please wait for contact from the Office. Please do not come to the Office without a scheduled appointment.
Reinstatement of appointments scheduled for June 1th, 2020.
All individuals that possess possess arequest to submit missing formal documents for their application for legalization of stay are asked to arrange appointment. The aforementioned individuals are to come to the Office with a valid passport or ID card and documents listed in the request.
Interviews and access to files (from June 15th, 2020)
Starting from June 15th, 2020 functions involving parties to proceedings are partially resumed (i.e. interviews and access to files). Initially, clients are going to receive their appointment dates via phone or email. Other individuals are going to receive their appointment dates via post. Please follow instructions listed in the letter.
We’re reminding of the sanitary rules which apply during visits in the Małopolska Provincial Office.
Only individuals without symptoms like fever, cough, and breathing difficulties may enter the Office.
One is to come with all the required documents concerning the case. Only individuals which possess complete documents in each given case will be allowed to enter the Office.
One is to wear a mask or different covering of mouth and nose as well as disposable gloves. One is to maintain proper distance from other individuals and Office employees (recommended distance is 2 meters).
Before entering the Office, one is to disinfect their hands at the designated point with provided hand sanitizer.
- Removal of mask or other covering of mouth and nose is to occur only per clear instructions from an Office employee for the purpose of identification, after backing up for a safe distance.
- During a visit on the premises of the Office one is to follow the provided rules of moving around.
- One is to consider the fact that there will be no access to bathrooms in the Office.
- In the case of violation of above-mentioned rules and arrangements visit in the Office will not be possible.
Receiving an appointment date for personal appearance in the Office does not exempt from undergoing quarantine or other forms of isolation associated with the epidemic hazard.
For your safety and due to the requirement of following provided sanitary guidelines issued for the purpose of preventing spread of the infectious disease COVID-19 caused by the SARS-CoV-2 virus, foreigners will be informed by the security guards and employees of the Office about the limitation of entrance to the Office by third parties.
Customer service will be conducted by meeting all sanitary requirements and ensuring safety of employees and customers. Scheduling appointments for foreigners which have submitted applications during the current period of imposed sanitary guidelines requires not only equipping the employees with necessary sanitary supplies, but also logistic solutions for documents, and coordination of moving around the office (entrance and exit) in order to prevent an excessive number of individuals from occupying the building.

WHERE TO FILE THE DOCUMENTS

ACQUISITION OF THE RIGHT OF PERMANENT RESIDENCE - APPLIES TO
- Nationals of the European Union Member States.
- Nationals of the member countries of the European Free Trade Association (EFTA) - parties to the agreement on the European Economic Area.
- Nationals of the Swiss Confederation.
- Family members of the nationals, referred to in points 1-3, who stay together in the Republic of Poland. The right of residence to which an EU national, referred to in:
o points 1 and 2 is entitled, applies also to a family member joining such EU national or staying with such EU national in the Republic of Poland;
o point 3 is entitled, applies also to a spouse and a child who is the national's or spouse's dependant, who join such EU national or stay with such EU national in the Republic of Poland.
The EU national has the right of stay for a period longer than 3 months if he/she meets one of the following requirements:
- is an employee or an entrepreneur;
- is covered by a general medical insurance or is entitled to health care services on the basis of provisions on coordination, pursuant to Art. 5 Point 23 of the Act on Healthcare Services Financed from the Public Funds of 27 August 2004 (Dz.U. [Journal of Laws] No. 210, Item 2135, as amended). Besides, he/she has financial resources which are sufficient to provide for himself/herself and his/her family members in Poland and which do not come from social assistance;
- He/she studies or does a professional training course in Poland and is covered with a general medical insurance or is entitled to health care services on the basis of provisions on coordination, pursuant to Art. 5 Point 23 of the Act on Healthcare Services Financed from the Public Funds of 27 August 2004. Besides, he/she has financial resources which are sufficient to provide for himself/herself and his/her family members in Poland and which do not come from social assistance;
- is a spouse of a Polish national.
The term "family member" includes:
- spouse of an EU national,
- EU national's or his/her spouse's child of up to 21 years of age or a child who is the national's or national's spouse's dependant,
- EU national's or his/her spouse's parent who is a dependant of an EU national or his/her spouse.

REQUIRED DOCUMENTS
EU national should provide:
- application,
- photocopy of a valid travel document (the page with personal details) or another document confirming his/her identity and citizenship,
- documents or written declarations confirming that the foregoing conditions of stay have been met.,
Besides:
An employee or an entrepreneur should also provide:
- a written declaration of an employer or an entity authorised to provide an EU national with work about the intention to provide the EU national with work or a certificate of performing a work, or
- copy of entry into the National Court Register, if separate regulations require such entry into the register, or a certificate of entry into the records of economic activity.
A person with financial resources and medical insurance:
- a document confirming medical insurance coverage or rights to avail of healthcare services pursuant to regulations on coordination of social security systems,
- a document confirming that the EU national has sufficient financial resources to provide for himself/herself and his/her family members, without the necessity to avail of social assistance services (e.g. credit card, confirmation that the EU national has payment instruments in a bank or another financial institution, approved with a seal and signature of an authorised employer of such bank or institution, issued not later than one month before filing an application for residence registration).
A student or a person doing a professional training course:
- certificate from a public or non-public college confirming admission to a college or referral to a professional training course,
- a document confirming medical insurance coverage or rights to avail of healthcare services pursuant to regulations on coordination of social security systems,
- a written declaration that the person has sufficient financial resources to provide for himself/herself and his/her family members, without the necessity to avail of social assistance services, or a certificate confirming that the person has such financial resources.
Spouse of a Polish national:
- a document confirming contracting a marriage with a Polish national.
Member of the EU national's family:
- 5 up-to-date photographs (undamaged, clear, colour, dimensions: 4.5 x 3.5 cm, showing a left semi profile of the head without headgear or dark glasses, with left ear visible and the face evenly illuminated. A person with congenital or acquired sight defects may attach to the application photographs of him/her with dark glasses, whereas a person who wears religion-related headgear - photographs of him/her with such headgear. The headgear, however, cannot make it impossible to identify such person),
- a certificate of registration of residence of the EU national, issued to the national of the European Union with whom a family member stays in the Republic of Poland and, besides:
- a document confirming contraction of marriage,
- a document confirming family relations and a document confirming person's age or the fact that he/she is EU national's dependant.
If the EU national intends to stay in the Republic of Poland in order to work here, the EU national, to whom restrictions in access to the labour market apply pursuant to international agreements, shall get the right of stay for a period longer than 3 months after obtaining a promise to issue a work permit for that territory.
A certificate of filing such application shall be promptly issued to the family member who is not an EU national.
The application must be filed personally, not later than on the day following the lapse of 3 months since entry into the territory of the Republic of Poland.
Requirement for the application to be filed personally does not apply to minors.

APPEAL PROCEDURES
EU nationals residence is registered and the EU national's certificate is issued promptly. Residence card of a family member of an EU national is issued not later than 6 months after the date of submitting an application form.
You have the right to appeal against the decision to the Head of the Office for Foreigners in Warsaw, through the agency of Małopolska province governor. Written appeals should be submitted within 14 days from the date of receiving the decision.

ADDITIONAL INFORMATION
A family member who is not a citizen of the European Union has the obligation to have an EU national's family member residence card that confirms his or her right of stay in the Republic of Poland and, together with a valid travel document, authorises such person to cross the border repeatedly without a visa.
An EU national's family member residence card is valid for 5 years. If the intended period of stay in the Republic of Poland of the EU national who is joined by his or her family member or with whom a family member stays is shorter than 5 years, then such document will be valid for the intended time of stay of the EU national.
Documents in foreign languages, attached to application forms must be submitted together with their translation into Polish, done by a sworn translator.
Residence permits, temporary residence permits, EU national's residence cards and documents of residence issued pursuant to the Act on the principles and conditions of entry and residence within the territory of the Republic of Poland of nationals of the Member States of the European Union and members of their families of 27 July 2002 (Dz.U. No 141, Item 1180, as amended) shall be valid for the period for which they have been issued.
Residence permit, settlement permit or a residence permit for a long-term EC resident releases an EU national from the obligation to register his or her residence.
Residence permit, settlement permit or a residence permit for a long-term EC resident releases an EU national's family member who is not an EU national from the obligation to have an EU national's family member residence card.
